Sharing your car | Australia hosts
We know of no law that says it’s illegal to share your car in Australia, but you’ll want to take into account insurance and leasing and/or financing considerations.
Insurance considerations
Protection via Resortifi
We don’t expect your insurer to cover losses that occur while your car is being shared. That’s why protection plans made available by Resortifi Travels Mutual provide $20,000,000 in legal liability protection for property damage and reimbursement for physical damage to your vehicle. The protection plans in Australia are not insurance.
Compulsory Third Party (CTP) insurance
Compulsory Third Party (CTP) insurance protects you and anyone driving your vehicle —in this case, guests who book your vehicle on Resortifi — from the financial cost of a vehicle accident that causes injury or death. The law requires you to have CTP insurance, also known as CTP green slip. Resortifi requires you to notify your CTP insurer of your plans to share your vehicle on Resortifi and to certify that you did so when you list your vehicle.
Sharing your vehicle on Resortifi may mean that you’ll need to upgrade your CTP insurance or that you’ll pay a higher premium. Every state in Australia requires CTP insurance for vehicle registration, but the specific requirements vary by state and territory. Your CTP insurer may penalise you if you fail to register your vehicle correctly and obtain the appropriate class of CTP.
Talk with your insurance provider about your plans to participate in peer-to-peer car-sharing and make it clear that it’s not ride-sharing. Your insurer’s response to car sharing will depend on their specific policies. Consult with your accountant, tax, and/or financial advisor to understand any additional obligations that may arise by changing or updating your CTP insurance. If they have concerns, we believe you should be able to remove your vehicle(s) from Resortifi and retain your personal auto insurance coverage.
CTP insurance by state and territory
Below is guidance on how to make the necessary updates at your location. We’ll do our best to keep this up to date, but it’s your responsibility to properly register your vehicle.
- Australia Capital Territory – Contact your Motor Accident Injuries (MAI) insurance provider and change the class to 25B – personal share vehicles. Contact can be made with Access Canberra on 13 22 81 or alternatively, the MAI Insurers can be contacted on AAMI (13 22 44), APIA (13 50 50), GIO (13 10 10), and NRMA (132 132). - New South Wales – You don’t need to make a specific change in your CTP. If the vehicle is predominantly for private use and some carsharing, you won’t need to change your registration class. However, if your vehicle’s main purpose is carsharing, you can register the vehicle for Business –- General usage. The NSW CTP Insurers can be contacted on AAMI (13 22 44), Allianz (1300 137 664), GIO (13 10 10), NRMA (132 132), QBE (133 723), and Youi (139 684). - Queensland – You must change the CTP class to class 4 – hire car (passenger vehicle and utility), and can be changed by contacting your QLD CTP provider. The QLD CTP providers can be contacted on AAI (Suncorp) (13 11 60), Allianz (131 000), QBE (07 3859 5666), and RACQ (13 19 05). You’ll also need to change the registration of your vehicle and its Purpose of Use. Visit the QLD Department of Transport & Main Roads and complete a Charge of Vehicle Particulars Notification (Form F3524). - South Australia – You must change your CTP premium class to Hire Car – Class 6 (if in metro areas) or Class 56 in the country areas. Service SA can be contacted on 13 10 84. For more information, visit South Australia CTP
- Tasmania – You must take your vehicle for inspection at an Approved Inspection Station (AIS) and update your CTP registration to MAIB Class 8 – Hire & Drive Service. - Victoria – If the vehicle is predominantly for private use and some car sharing, you won’t need to change your registration class. However, if your vehicle’s main purpose is for car sharing, you can register your vehicle in the “hire” category. Contact VicRoads on 13 11 71. Leasing/Financing considerations
Check the terms of any lease or financing agreements to ensure they don’t prohibit car sharing. While we don’t believe car sharing violates subleasing laws, there’s no guarantee that all law enforcement would agree as they may have specific requirements around insurance. If your vehicle has a lien against it, check the terms of your contract with the lienholder to ensure listing on Resortifi doesn’t violate the contract terms.
